This is an auction in which bids are expressed openly and an Auctioneer, along with bidder assistants, is used to promote active bidding.
A Sealed-Bid Sale describes an offering where the bidders submit their bids confidentially on pre-approved contract forms on a specific date. This, by nature, is private and is utilized for unique or hard to value situations.
A set of terms is established, and all bidders are obligated to sign the approved sales contract without changes, unless the seller has approved changes in advance. Sales are advertised "AS IS / WHERE IS" and only under the terms and conditions prescribed by the Seller in the published contract form. Substantial non-refundable deposits are made at the auction. The Buyer is required to increase the amount of the deposit to 10% within 5 days of the auction.
